Purpose and Effect

Of the Applications: The purpose of the application is to sever the land that is proposed by the Bornish Wind Power project for an electrical substation from the remaining agricultural land. The subject land is currently designated “Agricultural Areas” in the Township Official Plan. The Zoning By-law of the Township of Adelaide Metcalfe 34-2007 zones the subject land as General Agriculture (A) zone.

  •  This application was previously deferred by the Committee of Adjustment at a meeting on September 20, 2010. The applicant has since revised the proposal and now is seeking approval to sever a parcel of land 5.0 acres in size, previously they had requested permission to sever a 10 acre (4 hectare) parcel.

Township Planner’s Comments

Brandon Flewwelling, GSP Group, explained the application status, the power of the Committee of Adjustment and summarized the planning comments with conditions.

Applicant/Agent’s Comments

Derek Dudek explained the changes to the application. He also explained the status of NextEra according to the Ontario Power Association’s list of FIT projects, released in December, 2010:

  • Ranked 6th in the Southwest area;
  •  7th highest in the Province for FIT;
  • The power allotment is to be announced in the Spring (April-May, 2011) but will not likely know whether acceptance has been granted within the year, as per the planning process.
  • Condition #1 could be revised/reworded to address this matter (back to farm).

 Public Comments

John Peeters suggested to wait for approval then deal with the application at that time.

Harvey Wrightman said that the list is a wish list as some points have not had public meetings.

Doreen Orrange stated that she understands the original plan stated ten acres, however the new plan has five acres.

Fred Evans asked why the sub-station isn’t being located in North Middlesex. Mr. Dudek replied that there is no logical place for it in North Middlesex to connect to. Mr. Evans asked if public participation had been taken into consideration.

Mayor Bolton stated that the Township cannot stop the severance.

Doug Dawson, an owner in North Middlesex, stated that he had not received any information. Mr. Dudek said that he should have been notified and will look into it.

Linda Moore referred to poles issue.

Joe Minten asked where the lines would be placed. Mr. Dudek stated that they would be within the Municipality on the County’s right-of-way.

Jeff Maes asked if the lines would be buried. Mr. Dudek stated that it was a possibility.

Earl McNab stated that there is not a clear picture of where this will go. Residents want to know exactly where everything is on paper. Mr. McNab mentioned that the process should be done in order and to work with the public. He also suggested seeing what happens in Chatham-Kent.

Mr. Wrightman stated that there has been no noise study provided. He also stated that the Province should not be telling the Township how to deal with severances. More information is needed.

Anne Evans referred to the impact on real estate values.

Frank Boere made reference to stray voltage issue.

Craig Saari made reference to Hydro One upgrades issue.

Committee Comments

Councillor Stokman asked what the relevance of the Alberta drawings are to affected landowners in this area. Also, there is no housing near the Alberta sub-station. There is no new information. Plans should be drawn up for the affected area in Ontario.

 Deputy Mayor deBruyn stated that he agrees with Councillor Stokman. He also feels that the sub-station should be in North Middlesex.

Councillor Smith asked why the sub-station can’t be located in North Middlesex. There’s not enough information. He also agrees with Councillor Stokman.

Mayor Bolton referred to the stray voltage issue and said that it would be Hydro One’s problem. Mayor Bolton asked if there will be a noise study done. Mr. Dudek stated that it is mandatory and so it will be done. Mayor Bolton suggested that it could be a condition.

Mr. Flewwelling stated that there are two different processes involved. The severance issue is not a rubber stamp process. There are steps and studies which have to be done. This meeting is only to provide land for this sub-station.

Mrs. Orrange stated that the wind/noise study should be done independently and not hired by NextEra.

Mayor Bolton stated that at this meeting, the options are to approve, deny or defer the application for consent.

Joe VanBree suggested that noise studies should be performed now and in the future.

Blair Allen asked how to keep NextEra accountable.

After the comments, Mayor Bolton asked the Committee for a decision on the application.

Resolved that Consent Application #B05-2010, submitted by David & Terry Brand, for property at 29648 Kerwood Road, Part of Lot 7, Concession 3, NER (former Township of Adelaide) in the Township of Adelaide Metcalfe, BE DEFERRED until all regulatory approvals are in place. CARRIED.

Resolved that the public meeting ends and Council reconvene. CARRIED.

Councillor MacKinnon returned to the meeting at this point.
